Who we are

The Roadside Stalls (theroadsidestalls.com.au) is an Australian directory of roadside stalls, farmgate stalls, honesty boxes and farm-stay accommodation. In this policy, “we”, “us” and “our” mean The Roadside Stalls.

This policy explains what personal information we collect, why we collect it, who we share it with and the choices you have. We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth).

Information we collect

You can browse the directory without telling us who you are. We collect the following when you choose to use other features:

  • Your account: first and last name, username, display name, email address, password (stored in hashed form), bio, and any profile or banner image you add.
  • Listings: the stall or property name, description, products, address and map location, photos, video links, website and social media links, and any email address or phone number you enter. You can also tell us whether you are the business owner or an associate. Listing details are published on the site for anyone to see, so only enter what you are happy to make public.
  • Reviews and comments: your name, email address, rating and what you write. Your name and review are published.
  • Messages: private messages you send to other members through the site.
  • Favourites and saved searches: the listings and searches you save, and the email address we send search alerts to.
  • Listing claims: the details you give us to show you are connected with a listing.
  • Contact with us: whatever you include when you email us.

We do not currently take payments through the site, so we do not collect card or bank details.

When you visit, we and our service providers automatically collect your IP address, approximate location based on that address, browser and device type, operating system, the page that referred you, the pages you view and the date and time of your visit. Some of this is collected using cookies and similar technologies, explained below.

If you use a “near me” search, your browser will ask for permission to share your location. We only use it to show nearby listings, and you can say no.

Anyone who has visited a stall can add it to the directory, so a listing about your stall may have been submitted by someone else, or put together from information the business has made public. If that includes information about you that is wrong or that you would like removed, please contact us.

How we use your information

We use personal information to:

  • run the directory, and publish and manage listings and reviews
  • create and manage your account, and deliver messages between members
  • confirm who owns or is connected with a listing
  • send emails you need or have asked for, such as account notices, listing updates and saved search alerts
  • respond when you contact us
  • understand how the site is used so we can improve it
  • show advertising, which helps keep the site running
  • keep the site secure, and prevent spam, fraud and misuse
  • meet our legal obligations

We will only send you marketing emails if you have agreed to receive them or would reasonably expect them, and you can opt out at any time.

Images you upload

You keep the copyright. Owners keep the copyright to all images they upload to The Roadside Stalls. Uploading an image does not transfer ownership of it to us.

You can delete your images at any time. You can remove them by editing your listing or profile, or by emailing us at [email protected] and asking us to do it for you.

The licence you give us. By uploading an image, you grant The Roadside Stalls a worldwide, non-exclusive licence to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your images. This licence ends when you delete the image. Non-exclusive means you remain free to use your images however you like, and to license them to anyone else.

After you delete an image, we stop displaying it on the site. Copies can remain for a short time in website caches and backups until they are overwritten, and we cannot recall copies that have already been shared or saved by other people or services.

Only upload images you are entitled to use. That means images you own or have permission to upload, and please take care with photos that show other people. If someone else has uploaded your image, contact us and we will remove it.

Cookies, analytics and advertising

Cookies are small files stored by your browser. We use them to keep you signed in and remember your settings, and our providers use them for analytics, advertising and security. You can block or delete cookies in your browser settings, although some features, such as signing in, may stop working.

  • Google Analytics helps us understand how visitors use the site. Google offers a browser add-on to opt out.
  • Umami is an analytics tool run on a server operated by our web partner, Pogo. It records page visits and, through its session recording feature, how visitors interact with pages, such as where they click and scroll. Those recordings can include what appears on the page during your visit.
  • Independent Analytics runs on our own website and counts page views, referrers and general visitor statistics.
  • Google AdSense shows ads on the site. Google and other third-party vendors use cookies to serve ads based on your visits to this and other websites. You can read how Google uses this data and turn off personalised ads in My Ad Center.
  • Google Maps displays maps and looks up addresses, and Google reCAPTCHA helps protect forms from spam. Both receive information from your browser, including your IP address.

Who we share information with

We do not sell your personal information. We share it only as described in this policy, or:

  • with service providers that help us run the site, including our website hosting and backup providers, Cloudflare (security and content delivery), FastPixel (page and image delivery), Google (analytics, advertising, maps and spam protection), CleanTalk (spam filtering of forms and comments), SMTP2GO (email delivery), Gravatar (profile images linked to your email address) and our web partner, Pogo (site development, support and analytics)
  • with other visitors, where you publish something on the site such as a listing or review, or with the member you send a message to
  • where the law requires or allows it, or where it is needed to protect people, the site or our rights

Our site links to other websites, including stall websites, social media and our sponsors. Their privacy practices are their own, so please check their policies.

Overseas disclosure

Some of our service providers store or process information outside Australia. It is likely to be sent to the United States, New Zealand and countries in the European Union, and may also pass through other countries where those providers operate. Overseas recipients may not be subject to the same privacy protections as Australian organisations.

How we store and protect information

We store information electronically on our website server, in backups and with the service providers listed above. We take reasonable steps to protect it from misuse, loss and unauthorised access, including encrypted connections, spam and malware protection, and access controls. No website can be completely secure, so we cannot guarantee that information will never be compromised.

We keep personal information for as long as we need it for the purposes in this policy or as required by law, then delete or de-identify it. Listings and reviews generally stay published until they are edited or removed.

Access, correction and deletion

You can update most of your details by signing in and editing your profile or listing. You can also contact us to ask for a copy of the personal information we hold about you, to correct it, or to delete your account or listing. We will respond within a reasonable time, usually within 30 days. We may need to confirm your identity first, and if we cannot do what you ask, we will tell you why.

Complaints

If you think we have mishandled your personal information, please email us at [email protected] with the details. We will look into it and respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner.

Changes to this policy

We may update this policy from time to time. The latest version will always be on this page, with the date it was last updated at the top.
